These sales and delivery conditions (in the following named as the ”Terms”) apply to all purchases of goods on the Website, so please read our Terms and Conditions of Use carefully.
Access to the website
Missuna will do our utmost to ensure uninterrupted availability of the Website and those transmissions will be without errors. However, this cannot be guaranteed due to the nature of the Internet. You are responsible for evaluating the information and content provided on the Website. Your access to the Website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. Missuna will attempt to limit the frequency and duration of any such suspension or restriction.
By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which Missuna will not be responsible. Please see our notice for further information. To contract with us, you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Missuna retains the right to refuse any request made by you. If your order is accepted, Missuna will inform you by email and confirm the identity of the party which you have contracted with. When placing an order you undertake that all details you provide to Missuna are true and accurate, that you are an authorized user of the credit or debit card used to place your order, and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.
When you place an order, you will receive an e-mail confirming receipt of your order: this email will only be an acknowledgment and will not constitute acceptance of your order. A contract between us will not be formed until Missuna sends you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.
All products purchased from the Website are made according to a shipment contract. This means that the risk of loss for such products passes to you upon our delivery to the carrier. If you have received your Order Confirmation Email but your products have not arrived within a timely manner, please contact us and Missuna will do its best to assist. Note that during exceptionally busy periods (e.g. Christmas) or when the weather is particularly inclement please allow additional days before raising a query.
If your order has not been received within realistic timescales as further set out below, in the first instance please check with your local mail delivery office to see that they are not holding your parcel. If they confirm that they do not have your products, please contact Missuna.
Shipping costs will be added where applicable.
Returns and Refunds
You have the right to withdraw from your purchase without giving any reason within 14 days after delivery. The Right of Withdrawal period starts on the day you received the product(s).
Missuna is not responsible for shipping costs incurred in the return of a product. The return of the product is the responsibility of the customer, and will only be refunded if the return is our responsibility (i.e. defective product).
The returned items must be in perfect condition, should not have been used, handled, or washed, or have any damage, and must be returned with original tags, packaging, and a return invoice.
The refund will only be made after confirmation of the condition of the products, and will always use the same route for which the payment was made. In case of payment by PayPal or credit card, the refund will be credited to your PayPal account or card and immediately available.
When ordering products from the Website for delivery outside the European Union you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you as Missuna has no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact the local customs office for further information.
Additionally, please note that when ordering from the Website, you are considered the importer of record and must comply with all laws and regulations of the country in which the products are received. Your privacy is important to us, and we know that you care about how information about your order is used and shared. Missuna would like its international customers and customers dispatching products internationally to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.
Missuna will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
Pricing and availability
Whilst Missuna tries and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If Missuna discovers an error in the price of any goods which you have ordered you will be informed of this as soon as possible and you will be given the option of reconfirming your order at the correct price or cancelling it. If Missuna is unable to contact you, the order will be treated as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
The prices quoted on this Website are final prices (including VAT).
Missuna is not responsible for any changes in currency value or conversion rates that your bank or credit card company may use when charging in your country’s currency.
Stock levels are subject to availability and Missuna does the best to ensure all orders are packed accordingly to the desired quantities and styles. Should any order not be fulfilled by our warehouse upon packing due to items becoming out of stock, Missuna will inform you of this as soon as possible. Any orders will be holded or cancelled at this point of the process. Orders will be packed and shipped as usual in our normal processes and procedures.
Missuna will endeavour to deliver all products you have ordered in a timely manner.
Missuna accepts card payments by MBWAY, Easypay, Paypal, Cartões Visa e Mastercard. Upon receiving your order, it will be carried out a standard pre-authorization check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorization check has been completed. Your card will be debited once the order has been accepted.
Missuna has made every effort to display as accurately as possible the colors of our products that appear on the Website. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will be accurate.
Missuna reserves the right to make changes to our Website, policies, and these Terms and Conditions of Sale at any time. Your usage of the Website and your orders will be subject to the policies and Terms and Conditions of Sale in force at the time that you use the Website or that you order products from us unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of the provisions of these Terms and Conditions of Sale are deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of the remaining conditions.
Guarantees and Complains
Our products are guaranteed at the national and European Union level against manufacturing defects for 2 years, except for those which indicate otherwise.
Missuna guarantees the quality of the products sold on this website under the terms legally established, thus responding in case of any lack of conformity. Nevertheless, Missuna must remember that you must show sufficient evidence regarding the product's less conformity. If any of the products are not compliant you should let us know by speaking to our team and making a complaint about it, sending us an email to …@...com. Complaints will be considered and answered in 15 days.
