Overview

Welcome to Missuna Home. The terms "we", "us" and "our" refer to Missuna Home. We operate this store and website, including all related information, content, features, tools, products and services (the "services"). Missuna Home is powered by Shopify, which enables us to provide the services to you.

These terms of service, together with the policies referred to in them, describe your rights and responsibilities when you use the services.

By visiting or using our services, you agree to these terms and to our privacy policy. If you do not agree, please do not use the services.

Section 1: Access and account

By agreeing to these terms you confirm that you are at least 16 years old, or that you have reached the minimum age required in your country of residence.

To place an order you may be asked for information such as your email address and your billing, payment and shipping details. You confirm that the information you provide is correct and complete.

You are responsible for keeping your account credentials secure and for the activity on your account. You may not transfer or sell your account to anyone else.

Section 2: Our products

We make every effort to show our products accurately. Colors and appearance may differ depending on your device and its settings.

Our textiles are natural materials. Slight variations in texture, weave and shade are part of the material and are not defects.

Product descriptions may change at any time. We may discontinue a product or limit the quantity available to any person or region.

Section 3: Orders

When you place an order you are making an offer to purchase. We may accept or decline it.

The order confirmation email acknowledges that we received your order. The contract is formed when we confirm that the goods have been dispatched. Only the goods listed in that dispatch confirmation are covered by the contract.

If we decline, change or cancel an order, we will contact you using the details you provided. Where payment has already been taken, we refund it in full.

Your purchases are for your own personal or household use, not for commercial resale.

Section 4: Prices and payment

All prices shown include VAT at the applicable rate. Shipping costs are added at checkout and are shown before you pay.

Prices, discounts and promotions may change without notice. The price that applies is the one in effect when you place your order, as set out in your order confirmation.

If we find an error in the price of a product you ordered, we will tell you as soon as possible. You may then confirm the order at the correct price or cancel it. If we cannot reach you, the order is canceled and any payment refunded in full.

You confirm that you are authorized to use the payment method provided and that the details are correct.

Section 5: Shipping and delivery

Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs or events outside our control. This does not affect your statutory rights.

Section 6: Right to cancel and returns

If you are buying as a consumer, you have the right to cancel your order within 14 days without giving a reason.

Returns, refunds and the model withdrawal form are set out in our refund policy.

Section 7: Legal guarantee

Consumers have a legal guarantee of conformity of three years from delivery. If an item does not conform to the contract, you may ask for it to be repaired or replaced, or for a price reduction or refund, in the order and under the conditions set by law.

Section 8: Intellectual property

Our services, including trademarks, text, images, graphics, video and audio, and the selection and arrangement of these, are owned by Missuna Home or its licensors and are protected by intellectual property law.

These terms allow you to use the services for personal, non-commercial use only. You may not reproduce, distribute, modify, republish or transmit any of the material without our prior written consent.

The Missuna Home name, logo and product names are our trademarks. You may not use them without our prior written permission. Shopify's name and logo are trademarks of Shopify. All other marks belong to their respective owners.

Section 9: Third-party links and tools

The services may contain links to websites operated by third parties, and may give you access to tools provided by third parties. We do not control them and we do not review their content.

Access to third-party tools is provided as is and as available, without warranties of any kind. Any use of them is at your own risk. Please read the terms of the relevant provider before using them.

Questions or complaints about third-party products and services should be directed to that third party.

Section 10: Relationship with Shopify

Missuna Home is powered by Shopify, which enables us to provide the services to you. Any sale or purchase you make in our store is made directly with Missuna Home.

Shopify is not responsible for any aspect of the sale between you and Missuna Home, including any injury, damage or loss resulting from the products purchased.

Section 11: Privacy

Personal information collected through the services is handled as described in our privacy policy. Because the services are hosted by Shopify, certain personal information is also processed by Shopify.

Section 12: Feedback

If you send us ideas, suggestions, reviews or other content, you grant us a worldwide, royalty-free license to use, reproduce, modify, publish and display that content in connection with the services.

You confirm that you hold the rights to the content you send, and that it does not infringe the rights of others or contain unlawful, abusive or offensive material.

We are not obliged to keep your feedback confidential, to pay for it, or to respond to it. We may remove content that we consider unlawful or objectionable.

Section 13: Errors and inaccuracies

The services may occasionally contain typographical errors, inaccuracies or omissions relating to descriptions, prices, promotions, offers, shipping charges, transit times or availability.

We may correct any error and update or cancel orders where information was inaccurate, including after you have submitted your order.

Section 14: Prohibited uses

You may use the services for lawful purposes only. You may not use them:

· For any unlawful or malicious purpose, or in breach of any applicable law.

· To infringe our intellectual property rights or those of others.

· To harass, abuse, defame, intimidate or harm any person.

· To transmit false or misleading information, or to impersonate another person or entity.

· To send unsolicited advertising or promotional material.

· To upload or transmit viruses or any other malicious code.

· To collect or track the personal information of others.

· To interfere with, bypass or circumvent the security features of the services.

We may suspend or terminate your access if we determine that you have breached these terms.

Section 15: Automated access

Automated tools and agents, including shopping assistants, may access the services on your behalf, provided they do so in good faith.

Any automated tool must identify itself in its requests, must not conceal that it is automated, and must respect the technical measures we use to manage access, including robot exclusion headers and rate limits.

We may limit or block automated access that places an unreasonable load on the services, collects data at scale, circumvents security measures or is used for any purpose prohibited in Section 14.

Section 16: Termination

We may terminate this agreement or your access to the services at any time. You remain liable for amounts due up to the date of termination.

The sections on intellectual property, feedback, disclaimer of warranties, limitation of liability, indemnification, governing law and privacy continue to apply after termination.

Section 17: Disclaimer of warranties

Information on the services is provided for general information only. We do not warrant that it is complete or free of error, and any reliance you place on it is at your own risk.

Except as expressly stated by us, the services are provided as is and as available, without warranties or conditions of any kind. We do not guarantee that your use of the services will be uninterrupted, timely, secure or error free.

Nothing in this section limits the statutory rights of consumers, including the legal guarantee of conformity.

Section 18: Limitation of liability

To the fullest extent allowed by law, Missuna Home, its partners, employees, contractors, service providers and licensors, and those of Shopify, are not liable for any indirect, incidental or consequential damages, including lost profits, lost revenue, loss of data or replacement costs, arising from your use of the services or of any product purchased through them.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under applicable law. Consumers retain all mandatory statutory rights.

Section 19: Indemnification

You agree to indemnify and hold harmless Missuna Home, Shopify and our respective partners, officers, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, arising from your breach of these terms, your violation of any law or of the rights of a third party, or your use of the services.

We will notify you of any such claim. We may control its defense and settlement at your expense, but will not settle a claim that imposes non-monetary obligations on you without your consent, which you will not unreasonably withhold.

Section 20: Severability, waiver and entire agreement

If any provision of these terms is found to be unlawful or unenforceable, it is severed and the remaining provisions continue to apply.

Our failure to exercise or enforce any right does not constitute a waiver of that right.

These terms, together with the policies referred to in them, form the entire agreement between you and us regarding the services, and replace any previous agreements or versions.

Section 21: Assignment

You may not transfer or assign these terms or your rights under them without our prior written consent. We may transfer or assign them without notice to you, provided your rights are not reduced.

Section 22: Governing law and dispute resolution

These terms are governed by the laws of Portugal. If you are a consumer resident in the European Union, this does not deprive you of the protection of the mandatory rules of the law of the country where you live.

If a dispute arises, please write to us first at info@missunahome.com so that we can try to resolve it.

You may refer a consumer dispute to TRIAVE, Centro de Arbitragem de Conflitos de Consumo do Vale do Ave, Rua Capitão Alfredo Guimarães n.º 1, 4800-019 Guimarães, Portugal, at www.triave.pt. If you are a consumer resident in another European Union country, the European Consumer Centre in your country can help you access the competent body.

Consumers may bring proceedings before the courts of their country of residence. For any other user, the courts of Portugal have jurisdiction.

You can review the current version of these terms at any time on this page.

We may update or replace any part of these terms by posting the change on this page. We will give notice of material changes as required by law. Your continued use of the services after a change takes effect means that you accept it.
